Background

The appellant was convicted by a trial court in a POCSO/SC-ST Atrocities/IPC case and sentenced to a maximum of 4 years' rigorous imprisonment (sentences running concurrently). While his criminal appeal against conviction was pending before the Allahabad High Court, he sought suspension of his sentence under Section 389 CrPC so he could remain out on bail during the appeal, but the High Court declined, citing the gravity of the offence and reproducing the prosecution's case at length.

Decision Breakdown

The Supreme Court held that the High Court failed to apply well-settled principles governing suspension of a fixed-term sentence, reiterating that when a convict with a limited-duration sentence appeals, suspension should ordinarily be considered liberally unless there are exceptional circumstances, since an unsuspended sentence of 4 years could render a slow-moving 2024 appeal entirely infructuous by the time it is heard. The Court found the High Court's order legally flawed for merely restating the prosecution's evidence rather than weighing the correct factors for suspension of a fixed-term sentence. It set aside the High Court's order and remanded the matter for fresh consideration within 15 days, with the Court expressing disappointment at recurring, similar errors from the Allahabad High Court in such matters.

Lesson Learnt

For a fixed-term (not life) sentence, appellate courts must consider suspending the sentence liberally while an appeal is pending, unless there are genuinely exceptional circumstances, otherwise, the right to appeal risks becoming meaningless if the convict serves out the entire sentence before the appeal is even heard.
