Background

This order sends the case back; it does not decide the dispute. A temple claimed title to land under Patta No. 1, while the defendants claimed rights as occupancy ryots. The High Court ruled for the temple by treating it as a Mirasidar on the basis of rent receipts, although the patta itself had never been formally exhibited.

Decision Breakdown

This is not a final decision on the dispute. On 10 March 2015 the Court found that the High Court had acted a little hastily. It held that fresh determination was needed on whether the temple held title under Patta No. 1, whether it was a Mirasidar and to what extent, and whether the defendants were occupancy ryots under the 1908 Act. It set aside the High Court's order and sent the matter back for a fresh decision on these issues, allowing additional evidence to be led.

Lesson Learnt

There is no final ruling yet on who holds title or occupancy rights to the land. The parties may produce additional evidence before the Madras High Court.
