Background

The Animal Welfare Board challenged permission for Jallikattu, while connected cases concerned bullock-cart races and a central notification prohibiting bulls as performing animals. Welfare reports described practices causing animals pain, fear and injuries. Organisers defended the events as tradition, and Tamil Nadu relied on its 2009 law regulating Jallikattu.

Decision Breakdown

The Court held that the events as considered violated the Prevention of Cruelty to Animals Act and upheld the 2011 notification. It set aside the Madras High Court judgment and upheld the Bombay High Court decision. Tamil Nadu's 2009 law was unconstitutional because it conflicted with the central welfare legislation. The Court read protection against hunger, fear, discomfort, pain and restrictions on normal behaviour into the statutory duties toward animals. It directed authorities to enforce those protections and called for stronger legislation; this was the position decided in the 2014 judgment.

Lesson Learnt

Tradition and entertainment did not excuse the unnecessary suffering proved in these events. People responsible for animals had an affirmative statutory duty to safeguard their well-being, beyond merely preventing visible injury.
