Background

A government employees' association obtained permission to buy temple land for housing through a private negotiated sale. The required Gazette notice invited objections, but the later challengers had not objected then. A High Court single judge upheld the permission, while a Division Bench quashed it partly because land prices might appreciate more than the sale proceeds.

Decision Breakdown

The Supreme Court allowed the appeal, restored the single judge's judgment and upheld the Government's sale permission. Section 80 permitted a reasoned exception to public auction in the institution's interest, and the statutory notice process had been followed. The prospect of substantially higher annual income from the proceeds was a relevant benefit to the temple, while possible appreciation did not by itself make the sale improper. The Court also considered the recorded valuation and the lack of bona fides found in the later continuation of the litigation.

Lesson Learnt

Temple property sales must meet statutory safeguards, but an authorised private sale is not invalid simply because land might appreciate. The institution's income needs, adequate price and reasons for using the statutory exception all matter.
