Background

A woman and her family were assaulted at their farmhouse in 1993, and she alleged that Appa also took her jewellery. The trial court convicted him of robbery causing hurt and imposed seven years' rigorous imprisonment and a ₹1,000 fine; the High Court upheld that result. He challenged his identification and conviction, pointing to the nighttime incident, covered faces and absence of a formal identification parade.

Decision Breakdown

The Supreme Court partly allowed the appeal, replacing the robbery conviction under Section 394 of the Indian Penal Code with grievous hurt under Section 325. It accepted Appa's identification because the complainant knew him, the porch was lit and the witnesses had a close opportunity to observe him, making the absence of an identification parade non-fatal here. On this record, however, the alleged jewellery theft lacked sufficient supporting proof, so the robbery conviction could not stand. Witness and medical evidence did establish that his punch knocked out a tooth, allowing conviction for the lesser offence even though it was not separately charged. Considering his age, the long proceedings and roughly ten months already spent in custody, the Court reduced imprisonment to time served, retained the ₹1,000 fine and ordered immediate release unless custody was required in another case.

Lesson Learnt

Proof that someone caused a serious injury does not by itself prove the additional ingredients of robbery. A court can substitute a lesser offence supported by the evidence; the sentencing reduction here depended on Appa's particular circumstances.
