Background

The petitioner sought quashing of a 2026 FIR registered against him under Section 376 IPC (rape), based on a complaint that he had promised marriage, entered a physical relationship, and then refused to marry the complainant. After the FIR, chargesheet, and framing of charges, the couple got married and executed a compromise deed, and the complainant told the Court she was living happily in her marriage and wanted the case quashed.

Decision Breakdown

The Court directed police verification of the marriage and consulted both families, who confirmed the couple was living together happily with no objections. Citing Supreme Court precedent that even serious, non-compoundable offences like rape can be quashed on settlement where continuing the trial serves no meaningful purpose and the couple has moved on with their lives, the Court found the complainant's consistent, verified statement of a genuine reconciliation persuasive. The FIR and all consequential proceedings were quashed.

Lesson Learnt

While quashing a rape case on the basis of "settlement" is treated as an exception used sparingly by courts, it can happen where the parties have since married and the complainant, after independent verification, confirms she is genuinely settled and wishes to move forward, since the Court's goal is protecting the woman's welfare, not mechanical prosecution.
