Background

The appellant sought anticipatory bail (protection from arrest in advance) in connection with an FIR registered at Police Station Sello, District Wardha, Maharashtra, after his wife died roughly seven years into their marriage, at a location far from where he was at the time of the incident. He approached the Supreme Court by way of a criminal appeal after the matter reached it on special leave.

Decision Breakdown

The Supreme Court noted that the appellant's wife had died seven years after the marriage, at a place distant from where the appellant himself was at the time, and treated this as relevant to a prima facie assessment of the case against him. On that basis, the Court found it appropriate to grant him protection in the nature of anticipatory bail in connection with the FIR, and it disposed of the appeal as allowed on that basis, while directing him to cooperate with the investigation and remain present at the police station whenever summoned by the authorities.

Lesson Learnt

Anticipatory bail can be granted even in a serious case where the facts available at that early stage, such as physical distance between the accused and the scene, or timing inconsistent with immediate suspicion, raise real doubt about direct involvement, provided the person agrees to cooperate with the ongoing investigation.
