Background

This order sends the case back; it does not decide the dispute. The case involved a disputed house on a 40 by 60 feet plot. There was an unresolved factual dispute over whether the Bangalore Development Authority had taken possession of the remaining land and whether compensation for the entire land had been paid.

Decision Breakdown

This is not a final decision on the dispute. The Court did not decide these questions itself. It set aside the High Court's judgment and sent the matter back to the High Court to decide afresh after hearing the parties and considering the present position of the land. The parties were directed to appear before the High Court on 14 March 2016 and to maintain status quo in the meantime.

Lesson Learnt

There is no final ruling yet on possession of the land or on compensation. The High Court will decide those questions afresh.
