Background

Bank of Baroda sought to enforce arbitral awards against overseas judgment debtors: Red Beacon General Trading L.L.C. and connected respondents, based in the UAE. On the previous hearing date, nobody appeared on behalf of the Bank, and the Court had held off passing any adverse order in the interest of justice, giving the Bank another chance.

Decision Breakdown

When the matter was called out again on the revised list, still nobody appeared for the Bank of Baroda (the decree holder). Given this continued non-appearance despite an earlier opportunity, the Court dismissed the enforcement petition for want of prosecution, but expressly left it open to the Bank to apply for restoration if its underlying cause of action still survived.

Lesson Learnt

Even a decree holder pursuing enforcement of an award must actively prosecute the case: repeated non-appearance can result in dismissal, though courts often preserve a route back (restoration) rather than closing the door permanently.
