Background

The appellant owned a truck insured with National Insurance Company, which caught fire due to a short-circuit in Bihar during the policy period. The insurer repudiated the claim, contending the truck's National Permit authorization fee had not been paid beyond a certain date, making the permit invalid. The State Consumer Commission ruled in the owner's favour, but the National Consumer Disputes Redressal Commission reversed that decision, holding the claim could not be allowed without a valid permit.

Decision Breakdown

The Supreme Court examined the permit and found it valid until 13.10.2017, and held that the authorization fee was only required when the truck moved outside Bihar, since the truck was registered in Bihar and caught fire within the state, no such fee was due. The Court held the insurer's repudiation was on a "frivolous ground" and set aside the National Commission's order, restoring the State Commission's ruling in the owner's favour. It further directed the insurer to pay the claim within 60 days, with 9% annual interest running from the date the complaint was filed.

Lesson Learnt

An insurer cannot repudiate a legitimate motor insurance claim on a technical permit condition that does not actually apply to the vehicle's operating territory, and unreasonable delay by an insurer in honouring a valid claim can itself attract an interest liability.
