Background

The applicant sought regular bail in a 2022 case registered under the NDPS Act at PS Narela. His bail application had already been heard and dismissed on merits by a detailed judgment in April 2026, and a further bail application filed afterward was also dismissed for lack of any change in circumstances.

Decision Breakdown

The Court noted that no substantive change in circumstances had been shown to justify hearing the matter afresh, since even after the earlier detailed dismissal a repeat application had already failed on the same ground. With nothing new placed before it, the Court dismissed the present bail application in a short order.

Lesson Learnt

Courts will not repeatedly re-examine a bail plea already rejected on merits unless the applicant can point to a genuine change in circumstances since the earlier order.
