Background

Land was acquired for defence research under notifications issued in 1993 and 1995. The initial award was substantially increased by the reference court and again by the Karnataka High Court. The acquiring side challenged the higher compensation based on an earlier award for nearby comparable land.

Decision Breakdown

The Supreme Court dismissed the appeals and special-leave petitions. The High Court had found that the acquired land and the exemplar land were contiguous and in the same geographical setting, with comparable potential value. Its use of the earlier award and an annual increase therefore had a justified evidentiary basis. The Court found no cogent reason to interfere with the enhanced rates of Rs. 7,70,000 per acre for the 1993 acquisitions and Rs. 8,40,000 for the 1995 acquisition.

Lesson Learnt

An award for genuinely comparable neighbouring land can support fair acquisition compensation. The comparison must rest on location and potential at the relevant acquisition time, rather than the original administrative valuation alone.
