Background

The Delhi Development Authority (DDA) had initiated land acquisition proceedings against the respondent's land years earlier, but had neither taken physical possession nor paid compensation within the time the law required. The landowner successfully argued before the High Court that the acquisition had "lapsed" under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. DDA appealed that finding to the Supreme Court.

Decision Breakdown

The two-judge Bench held that the point of law involved was already settled against DDA by its own earlier decision in Civil Appeal No. 8477 of 2016 (arising from SLP(C) No. 8467 of 2015), so the appeal was dismissed on that basis without re-arguing the merits. However, as a one-time concession on the particular facts, the Court gave DDA one year from the date of judgment to issue a fresh Section 11 notification and restart acquisition properly. If DDA failed to do so within that year, and it was still in physical possession, it was directed to hand the land back to the original owner.

Lesson Learnt

If a government body sits on an acquisition for years without paying compensation or taking possession, the acquisition can lapse under Section 24(2) of the 2013 Act and the land effectively reverts to the original owner, though courts may still give the authority a final, time-bound chance to start over properly rather than losing the land outright.
