Another in the same batch of DDA appeals over land acquisition that had lapsed, raising the same legal question already decided against DDA in Civil Appeal No. 8477 of 2016 (arising from SLP (C) No. 8467 of 2015).

Decision Breakdown

The Court dismissed the appeal, following the earlier precedent, but gave DDA one year from the date of judgment to issue a fresh notification under Section 11 and restart acquisition under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Failing that, if DDA held possession of the land, it was ordered to return it to the original owner.

Lesson Learnt

The one-year deadline to restart a lapsed land acquisition, or return the land, was applied uniformly to DDA across this entire batch of cases, showing courts treat such statutory timelines as non-negotiable regardless of how many similar appeals an authority files.
