Background

The Delhi Development Authority (DDA) appealed against a ruling that its land acquisition proceedings against Ishwar Singh had lapsed. The Supreme Court noted that this exact legal issue had already been decided against DDA in a companion judgment (Civil Appeal No. 8477 of 2016).

Decision Breakdown

Following its own precedent in the companion DDA case, the Court dismissed DDA's appeal. However, as a one-off concession on these facts, the Court gave DDA one year from the date of the order to restart acquisition proceedings afresh under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. If DDA failed to issue a fresh Section 11 notification within that year, it was directed to hand back physical possession of the land to the original owner if it was still in possession.

Lesson Learnt

When a government acquiring authority fails to complete the land acquisition process in time, the acquisition can lapse and the land effectively reverts to the original owner: courts can, however, give the authority a limited window to restart the process properly rather than losing the land outright.
