Background

The Delhi Development Authority (DDA) argued that it could not take possession of certain acquired land or pay compensation to the respondent landowners because of a stay order that was operating on the matter. However, the respondents' counsel clarified that the stay in question was actually confined to a separate case (Ruchi Vihar Housing Welfare Society vs. Govt. of NCT of Delhi) and that the respondents were neither parties to that case nor members of that society, so no stay applied to their land.

Decision Breakdown

Once it was established that there was in fact no stay operating with respect to the respondents' land, the Supreme Court held that nothing had prevented the DDA from taking possession or paying compensation within the time limit set by Section 24(2) of the 2013 Act. Since the DDA had admittedly failed to comply with that statutory requirement, the Court found no merit in the DDA's appeals and dismissed them.

Lesson Learnt

A government authority cannot excuse its own failure to meet a statutory deadline for taking possession or paying compensation by pointing to a court stay that, on examination, never actually applied to the land or parties in question.
