Background

The Delhi Development Authority (DDA) had acquired land, and the original landowner challenged the acquisition. DDA appealed to the Supreme Court against an order favouring the landowner. The Court noted that this appeal raised, in principle, the very same issue already decided against DDA in an earlier case (Civil Appeal No.8477 of 2016).

Decision Breakdown

The Court granted leave and then dismissed DDA's appeal, applying its earlier ruling on the same point. As a concession specific to this case, DDA was given one year from the date of the order to exercise its liberty under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, to start fresh acquisition proceedings by issuing a Section 11 notification. If DDA failed to do so within that year, and if it was in possession of the land, it was directed to hand back physical possession to the original landowner.

Lesson Learnt

When old land acquisitions are found legally deficient under the 2013 land acquisition law, the acquiring authority gets only a limited window to restart the process properly: if it misses that window, it must return the land to its original owner.
