Background

DDA appealed a ruling in favour of respondent landowner Rajbir Singh in a land acquisition dispute. The issue was identical to one already decided in the Court's lead judgment, Civil Appeal No. 8477 of 2016 (arising out of S.L.P.(C) No. 8467 of 2015), on whether the original acquisition proceedings had lapsed.

Decision Breakdown

The Bench held the point of principle was covered against DDA by the lead case and dismissed the appeal. Given the specific facts, it granted DDA one year to initiate fresh acquisition proceedings under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, via a Section 11 notification, failing which DDA (if in possession) would have to return physical possession of the land to the original owner.

Lesson Learnt

A lapsed land acquisition is not necessarily fatal to the acquiring authority's claim: courts can allow a limited window to restart the process properly, but if unused, possession must revert to the original landowner.
