Background

The Delhi Development Authority (DDA) appealed against a High Court order concerning land that had been the subject of an acquisition process. The core legal question, whether DDA's acquisition had lapsed, was identical to the issue already decided against DDA in a separate, earlier case (Civil Appeal No. 8477 of 2016).

Decision Breakdown

The Supreme Court held that the issue was already covered against DDA by its own ruling in Civil Appeal No. 8477 of 2016, and dismissed the appeal on that basis. As a concession, the Court gave DDA one year from the date of judgment to initiate fresh acquisition proceedings by issuing a fresh notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, using its liberty under Section 24(2) of that Act. If DDA failed to act within that year, and was in possession of the land, it was directed to hand back physical possession to the original landowner.

Lesson Learnt

When a land acquisition process stalls for too long without compensation being paid or possession taken, the law allows it to lapse, giving landowners a real chance to reclaim their land, but authorities are given a defined window to start over rather than losing the land forever.
