Background

DDA had acquired land belonging to Tilak Raj and others, but possession had not been taken and the compensation process had not been completed within the statutory timeframe. The landowners obtained a ruling below that the acquisition had lapsed under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. DDA appealed.

Decision Breakdown

The Supreme Court held that this was the same recurring issue already decided against DDA in the lead judgment, Civil Appeal No. 8477 of 2016, and dismissed the appeal on that basis. It nonetheless gave DDA a one-year window from the date of the order to initiate fresh acquisition proceedings by issuing a new Section 11 notification, directing that if no fresh notification issued within that year, DDA (if in possession) must hand the land back to the original owner.

Lesson Learnt

A long delay by a land-acquiring authority in taking possession and completing compensation can cause an old acquisition to lapse by operation of law, giving landowners a path to recover their land, though the Court may still allow the authority a fixed period to restart the process properly.
