Background

The Delhi Development Authority (DDA) had initiated land acquisition proceedings against Zile Singh's land years earlier, but by the time the 2013 land acquisition law came into force, the DDA had neither taken physical possession of the land nor paid compensation to the owner. The High Court held that under Section 24(2) of the new Act, such long-pending acquisition proceedings automatically lapse in these circumstances, and DDA appealed that finding to the Supreme Court.

Decision Breakdown

The Supreme Court held that this issue was already settled against DDA by its judgment in a companion matter, Civil Appeal No.8477 of 2016, and dismissed the appeal on that basis, confirming the acquisition had lapsed. As a one-time concession given the peculiar facts, the Court gave DDA one year to start a fresh acquisition (by issuing a new Section 11 notification) if it still wanted the land, failing which, if DDA was in possession, it had to hand the land back to the original owner.

Lesson Learnt

Under land acquisition law, an authority that neither pays compensation nor takes possession within the statutory window risks the entire acquisition lapsing, even after a long legal battle: landowners are not left to wait indefinitely for compensation that never arrives.
