Background

The Punjab Department of Mines and Geology obtained environmental clearance to mine sand from the riverbed of the river Satluj in a village in Ludhiana district, representing that the mining area was entirely within the active riverbed away from agricultural land. After the Department auctioned mining rights and sought to transfer the clearances to successful bidders, a joint inspection by Revenue and Mining officials found that several of the plots were actually located in agricultural land and under flood-protection structures, not in the active river channel as originally represented. The clearance was revoked, and the Department's appeals to the National Green Tribunal were dismissed, leading to this further appeal before the Supreme Court.

Decision Breakdown

The Supreme Court upheld the Tribunal's decision, finding no reason to interfere with the revocation of the environmental clearance. It held that the ground-level joint demarcation report showed the actual site conditions were materially different from what the Department had represented in its original application: some plots were under private agricultural cultivation and flood-protection "Bundhs," undermining the claim of natural river-silt replenishment. Since the clearance had been granted based on inaccurate information, its revocation by the competent authority was justified and had been correctly upheld by the Tribunal. The Court dismissed the appeals but clarified this would not bar the Department from filing a fresh, accurate application for environmental clearance.

An environmental clearance obtained on the basis of inaccurate site information can be revoked once ground verification exposes the discrepancy, and a citizen or authority must ensure representations made in regulatory applications match actual ground conditions.
