Background

The appellant's reference seeking enhanced compensation under Section 18 of the Land Acquisition Act, 1894 had been dismissed by the Reference Court back in 2001 for non-payment of the required court fee, and his attempt to get it restored failed, as did his challenge before the High Court. He then appealed to the Supreme Court, pointing out that in similar cases the Reference Court had allowed restoration on condition that the delay-period's statutory benefits be waived.

Decision Breakdown

The Supreme Court granted leave and disposed of the appeal by restoring the reference, but only on the condition that the appellant pay the required court fee within one month. It further directed that if the Reference Court eventually grants any enhancement in compensation, the appellant would not be entitled to statutory interest/benefits for the entire period of delay: from the original 2001 dismissal until the 2018 Supreme Court order.

Lesson Learnt

A land-acquisition compensation reference dismissed only for a technical defect like unpaid court fees can be restored on fair terms, but a long delay in fixing such a defect can cost the claimant statutory benefits (like interest) for the period of delay.
