Background

This order sends the case back; it does not decide the dispute. A plaintiff sued for specific performance of an agreement to sell land in a Gwalior civil suit. The trial court dismissed the suit, but the High Court reversed and decreed specific performance only on a finding that one disputed agreement, Exhibit P-1, was genuine.

Decision Breakdown

This is not a final decision on the dispute. The Court held that the High Court erred in deciding the matter on that narrow basis alone, without considering other essential aspects of a specific performance suit such as the plaintiff's readiness and willingness. It set aside the High Court's judgment and remitted the First Appeal to the High Court for a fresh hearing. The Court said it had expressed no opinion on the merits, including the validity or genuineness of documents and the readiness and willingness aspect.

Lesson Learnt

There is no final ruling yet on whether specific performance should be granted. A court cannot decree specific performance only because the agreement is genuine; it must also examine the plaintiff's readiness and willingness.
