Delhi Metro Rail Corporation (DMRC), as decree holder, had filed an enforcement petition against Parsvnath Developers Ltd., the judgment debtor, but by the time of the hearing had already received money as an adjustment of the amount owed under a reciprocal obligation between the parties.
Since the amount had effectively been settled, DMRC's counsel sought leave to withdraw the petition, with liberty to refile it later if needed, and after resolving any pending stamp duty issues in line with a prior ruling of the Court on stamp duty for such awards. The Court granted the leave and liberty sought and dismissed the petition and all pending applications as withdrawn.
