Background

Reddy, a Deputy Registrar of the university, was suspended in 1995 over allegations that he tampered with an MBBS marks list and forged letters to help a student pass. He was later removed from service. A Single Judge of the High Court found procedural irregularities and natural justice violations in the departmental proceedings, and the Division Bench upheld that view. The university appealed to the Supreme Court.

Decision Breakdown

The Supreme Court held that it was in the interest of justice to implement the Single Judge's direction by substituting the dismissal or removal with another suitable punishment. The substituted punishment was to take effect from the original date of punishment, 5 March 1997. Monetary benefits, including pensionary benefits if any, were to be paid within ten weeks. Arrears were to carry 6% interest from 5 March 1997. The civil appeal was disposed of on those terms.

Lesson Learnt

Where an employer's disciplinary process is flawed, the courts can require a fresh and lawful penalty instead of upholding dismissal, and the employee can recover back-dated pay and benefits. Institutions must follow fair procedure before removing an employee.
