Background

An arbitration award largely favoured a contractor constructing the Mumbra bypass for Maharashtra. On the same day, the State challenged the award in the Thane District Court while the contractor challenged other parts in the Bombay High Court. The dispute before the Supreme Court concerned which court should hear the competing challenges together.

Decision Breakdown

The Supreme Court upheld adjudication by the Bombay High Court, although for reasons different from the High Court's own. Where both were available, the statutory definition of court indicated a choice in favour of the High Court exercising ordinary original civil jurisdiction over the principal District Court. Section 42 did not resolve the particular same-day filing situation. The District Judge was directed to transfer both State applications to the High Court for decision alongside the contractor's petition, leaving the award's substantive validity to that court.

Lesson Learnt

An arbitration award challenge must reach the legally competent forum, and connected challenges should not produce conflicting proceedings in different courts. This ruling resolved forum choice in the statutory setting and competing filings before it, not whether the contractor's monetary award was correct.
