Background

The petitioner alleged that authorities had not complied with fifteen directions previously issued regarding the Kudankulam nuclear project. He challenged the clearance for Unit 1's first approach to criticality and sought to stop commissioning pending independent verification. Regulators, the operator and local authorities submitted detailed compliance affidavits and status reports.

Decision Breakdown

The Court disposed of the petition and application without issuing further directions or appointing the requested committee. The materials showed that the authorities were properly addressing the earlier directions and taking necessary steps, although some measures needed more time. Reports covered equipment checks, spent-fuel storage, environmental monitoring and local emergency and development measures. The Court expected continued implementation in letter and spirit rather than declaring every task already complete. It also left the remaining criminal cases against protesters for the trial courts, expressing no view on whether they should proceed.

Lesson Learnt

Courts can assess implementation through detailed regulatory reports without ordering a new expert committee at every stage. Disposal of this challenge did not cancel the earlier safety directions or pronounce all continuing obligations complete.
