Background

The appellant owned a multi-storey building in New Delhi that was insured under a Householder Insurance Policy for Rs. 1.50 crore. Heavy rainfall between 25-31 August 2016 flooded the basement while the appellant was out of town, damaging furniture, fittings, and other belongings stored there. A surveyor first inspected and assessed the loss, but the insurer later commissioned a second survey that reached a very different, much lower conclusion, and on that basis the National Consumer Disputes Redressal Commission (NCDRC) dismissed the appellant's compensation complaint.

Decision Breakdown

The Supreme Court found the insurer's abrupt reliance on a second, belated survey - without explaining why the first survey's findings were being discarded - to be arbitrary and unjustified. Since there were no substantive grounds to doubt the original survey, the Court set aside the second survey report and the NCDRC's order based on it. Rather than deciding the exact compensation itself, the Court remanded the matter back to the NCDRC solely to determine the appropriate quantum of compensation payable under the policy terms.

Lesson Learnt

An insurer cannot arbitrarily discard its own surveyor's assessment and substitute a later, unexplained one to defeat a genuine claim; courts and commissions will scrutinize unexplained reversals in an insurer's own assessment process.
