Background

The plaintiffs (respondents in this appeal), as grandsons of one branch, sued for a declaration of ownership over "A schedule" property, or alternatively for partition of a half share in a larger "B schedule" property. The defendant's legal heirs (the appellants) resisted the claim, asserting adverse possession over the entire property through a chain of sale transactions.

Decision Breakdown

The Supreme Court upheld the concurring findings of the Trial Court and the High Court's Division Bench that the defendant had failed to prove exclusive possession to the exclusion of the plaintiffs. The Court found that revenue records (pattas) and house-tax receipts showed both parties' names, indicating joint possession rather than the exclusive possession required to establish adverse possession. Since the plaintiffs had satisfactorily proved their ownership of the "A schedule" property through the documented chain of succession and partition, the Court saw no reason to interfere with the High Court's judgment and dismissed the appeal.

Lesson Learnt

A claim of adverse possession requires clear proof of exclusive, uninterrupted possession to the deliberate exclusion of the true owner; if official records like revenue pattas or tax receipts continue to show both parties' names, courts will treat the possession as joint, not adverse, and the claim will fail.
