Background

The Gujarat Water Supply & Sewerage Board's Letters Patent Appeal had been dismissed by a Division Bench of the Gujarat High Court. The Board appealed to the Supreme Court by special leave against that dismissal.

Decision Breakdown

The Supreme Court noted that, in light of its own recent ruling in Jogendrasinhji Vijaysinghji vs. State of Gujarat (2015) 9 SCC 1, which clarified the correct procedure/forum for such Letters Patent Appeals, the Division Bench's judgment could not stand. It set aside the High Court's judgment and restored the Letters Patent Appeal to its original number on the High Court's docket, directing the parties to appear before the High Court on 15 February 2016 so the appeal could be decided afresh on its merits. The civil appeals before the Supreme Court were themselves fully allowed and disposed of, with no order as to costs.

Lesson Learnt

When a point of procedure governing how an appeal should be heard is later clarified by the Supreme Court, earlier High Court judgments that did not follow that procedure can be set aside and sent back for a fresh hearing on the merits: the Supreme Court's role here was to fix the correct process, not to decide the underlying dispute itself.
