Background

Devender Gupta, Chairman of a college in Gurgaon, filed a criminal complaint against Gurmeet Kaur, who at the relevant time was the District Town Planner (Enforcement), alleging that she forcibly entered the college campus in 2006-07 with police and machinery and carried out a demolition, allegedly motivated by the complainant's refusal to pay a bribe demanded by a co-accused. A Magistrate summoned Gurmeet Kaur and others under several IPC sections. She sought quashing of the complaint under Section 482 CrPC before the Punjab and Haryana High Court, which dismissed her petition as not maintainable.

Decision Breakdown

The Supreme Court held that the demolition action, even if disputed on its legality, was carried out by Gurmeet Kaur in her capacity as a public servant discharging (or purporting to discharge) her official duties. Prosecuting a public servant for acts connected with official duty requires prior sanction under Section 197 CrPC, which had never been obtained in this case. Because no sanction was sought or granted, the Court held that the very initiation of the criminal complaint was "non est" (void from the start), and quashed the summoning order and all consequent proceedings. The Court, however, left it open to the complainant to seek the requisite sanction and pursue the matter afresh in accordance with law.

Lesson Learnt

A public servant cannot be criminally prosecuted for acts done, or purportedly done, in discharge of official duty unless the prosecuting authority first obtains sanction under Section 197 CrPC: proceedings launched without such sanction are void from inception.
