Contempt of CourtSupreme Court of India

Gurupada Bera & Ors. v. Binod Kumar & Ors.

Contempt Petition · 2026 INSC 20Decided 6 Jan 2026
Contempt Petitions (Civil)
Justice Vikram Nath · Justice Sandeep Mehta

Background

Part-time contractual teachers alleged West Bengal officials failed to comply with a 2024 Supreme Court order directing salary parity for certain periods, since they were never given a hearing on their representations.

Decision Breakdown

The State's own counsel conceded no hearing had been given and records hadn't been called for. Rather than finding willful contempt, the Court granted fresh liberty to submit representations, directed a proper hearing with records review, and a reasoned order within four months.

Lesson Learnt

A contempt petition against government doesn't always end in punishment. Courts often use it to secure proper process (like a fair hearing), which is itself an enforceable right.
