Special Leave Petition (Civil) No. 39434 of 2013
Justice B.S. Chauhan · Justice J. Chelameswar

Background

A cooperative federation pursued a Supreme Court challenge over an employee's medical reimbursement of Rs. 8,724. The Court noted that the cost of filing the challenge likely exceeded the amount at stake. It criticised officials' tendency to litigate small claims using public money instead of taking responsibility for resolving them.

Decision Breakdown

The Supreme Court dismissed the special leave petition while leaving any question of law open. It held the federation's pursuit of this petty reimbursement dispute to be an unjustified use of litigation resources. The Managing Director who had signed the supporting affidavit was directed to bear the litigation expenses personally, rather than charge them to the federation. Copies of the order were to be sent to the Haryana Chief Secretary and the Managing Director. The short order addressed litigation conduct and costs, without laying down a general medical-reimbursement entitlement rule.

Lesson Learnt

Public-sector decision-makers should weigh the cost and purpose of challenging small claims. Unnecessary litigation can waste both public funds and court time, and officials may face personal cost consequences in an appropriate case.
