The employer was given two months to disburse the benefits, with a warning that delay would attract 18% annual interest and personal liability for the responsible officers.

Lesson Learnt

When employees are retained in service under a court's own specific direction, an employer cannot later treat them as "surplus" to deny them service benefits like ACP, and courts can make compliance orders personally enforceable against responsible officers to ensure quick payment.
