Background

Chandigarh police constables disputed their seniority after changes to the rules governing selection for head-constable training. A tribunal extended an earlier ruling about old vacancies to all confirmed constables, affecting officers selected under the later competitive system who had not been made parties. The High Court ordered seniority to be recast while protecting existing posts from reversion.

Decision Breakdown

The Court dismissed the appeal and upheld the High Court's result. The earlier tribunal ruling protected consideration under the old rules only for vacancies that had arisen before the amendment; it did not give every confirmed constable a permanent right to the old selection process. The later tribunal order misunderstood that limit and affected identifiable selected officers without hearing them. The Court also used its power to do complete justice to prevent that defective order from perpetuating an incorrect seniority arrangement.

Lesson Learnt

Employees whose promotions or seniority will be directly affected should have an opportunity to be heard. A ruling protecting vacancies under earlier rules cannot automatically be expanded into a continuing entitlement for every employee.
