The petitioner (named in the judgment's cause-title only as "Health") alleged that the respondent, engaged under two Fund Raising Services Agreements from 2021, had defaulted on its obligations despite receiving an advance of Rs. 6,14,500, and sought a refund plus compensation through arbitration.
Finding both parties amenable to mediation, the Court first referred the matter to the Delhi High Court's Mediation and Conciliation Centre (Samadhan), directing the parties to attempt settlement within three weeks. As a fallback if mediation failed, since both sides agreed a valid arbitration clause existed, the Court simultaneously appointed a sole arbitrator to take over the dispute, while leaving the respondent free to raise limitation and jurisdiction objections before the arbitrator.
Courts increasingly try to nudge commercial disputes toward mediation as a first, cheaper, faster option, while still keeping arbitration ready as a fallback so the case doesn't lose time if mediation doesn't work out.
