Background

The Patna High Court's administrative side refused a judicial officer continued service beyond age fifty-eight. Its judicial side required reconsideration, noting an old adverse remark that had not been communicated, closure of that matter, later favourable records and subsequent promotions.

Decision Breakdown

The Court dismissed the High Court's appeal and upheld interference with the administrative decision. Judicial review of such assessments is limited, and another officer receiving an extension does not establish this officer's entitlement. Here, however, the closed adverse episode and subsequent promotions and favourable record left the refusal unjustified. After nearly fourteen years, a further assessment would serve little purpose, so the officer was to be treated as retiring at sixty and receive the resulting pay and pension benefits without delay.

Lesson Learnt

Even where extended service is a benefit rather than an automatic right, a refusal must rest on a defensible assessment of the person's actual service record.
