Background

This order sends the case back; it does not decide the dispute. Two senior NAFED officials were accused in a case involving non-agricultural business transactions and alleged financial wrongdoing. The High Court quashed proceedings against one official while accepting arguments that placed responsibility on Homi Rajvansh, who had not been made a party or heard there.

Decision Breakdown

This is not a final decision on the dispute. The Court set aside the quashing judgment and sent the matter back to the High Court. Because the alleged roles were interconnected and the judgment made specific adverse findings about Rajvansh, deciding the matter without hearing him violated fair procedure. The High Court also exceeded the proper limits of preliminary examination by effectively evaluating the allegations as though at trial. Rajvansh was to be added as a respondent and all parties heard afresh, preferably within six months; the Court did not decide either official's guilt.

Lesson Learnt

A court should not clear one accused by making adverse findings about an interconnected co-accused without hearing that person; quashing proceedings is not a substitute for trial.
