Background

A manufacturer supplied copper rods to a processor to turn into wire and alleged that more than six tonnes remained unreturned and had been misappropriated. After investigation, the Magistrate took cognizance and issued summons. The High Court quashed the proceedings for absence of a breach-of-trust offence, and the manufacturer appealed.

Decision Breakdown

The Supreme Court allowed the appeal and set aside the quashing order. Having examined the FIR and invoices, it held that the complaint and summons should not have been cancelled at the threshold. The criminal court was left to decide the allegations on the evidence produced by both sides. The Supreme Court expressly gave no opinion on guilt or the ultimate merits, so restoration of the case was not a finding that the copper had been dishonestly taken.

Lesson Learnt

A commercial relationship does not automatically make an allegation of misappropriated entrusted goods unsuitable for criminal examination. Restoring proceedings simply permits the evidence to be tested; it does not establish the accused's guilt.
