Background

Members of a cooperative housing society had been allotted plots by the Indore Development Authority (IDA) according to a Resolution tying allotment priority to the seniority/date of payment by each member. A District Consumer Forum directed execution of lease deeds for members who had completed payment and already been allotted plots, which the State Consumer Disputes Redressal Commission, Bhopal, upheld on appeal (while setting aside the cost and mental-agony compensation awarded below), subject to the Cooperative Societies Registrar finalizing a seniority list. The IDA then brought a batch of 26 connected appeals to the Supreme Court, though it clarified it had no real dispute with the underlying scheme and simply wanted the proceedings finalized.

Decision Breakdown

The Supreme Court noted the IDA's position that it wished to implement the Resolution but had been held up because the Joint Registrar of Cooperative Societies had not yet finalized the list of eligible members. The Court declined to implead the Registrar as a party but instead directed the Joint Registrar to positively finalize the list within three months, in accordance with the State Commission's order and the law, and directed the IDA to complete allotment/execution of lease deeds within one month of receiving that finalized list. On this basis, all the connected appeals (and applications) were disposed of, with the Registry directed to communicate the order to the Joint Registrar and the IDA.

Lesson Learnt

Where the substantive entitlement (who gets a plot, and in what order) has already been settled by the consumer fora below, the Supreme Court will step in mainly to fix a firm timeline so that bureaucratic delay, here, a pending seniority list, does not indefinitely stall implementation of relief that has already been granted.
