Background

Police in FIR No. 287/2023 recovered about 3.4 kg of opium from two people at a Delhi bus stand in December 2023. The prosecution alleges that the applicant, arrested in April 2024, was the intended recipient of the drugs and had sent money to the suppliers' bank accounts to buy them. The prosecution accepted that no drugs were recovered from the applicant himself.

Decision Breakdown

The applicant argued that no recovery had been made from him, that the main supplier and the two persons carrying the opium had all been granted bail, and that he had been in custody since 2024. The State confirmed that the other co-accused had also been granted bail. Relying on parity, the Court held that there was no impediment to granting regular bail to the applicant. Bail was granted subject to conditions including attending every hearing, giving a permanent address and a working mobile number, reporting to the local police station on the first Monday of each month, and not tampering with evidence.

Lesson Learnt

Where co-accused in the same case have been released, courts may apply the principle of "parity" and extend similar relief to other accused. Bail in narcotics cases still carries strict reporting and non-interference conditions.
