Background

The appellant had lodged an FIR against the respondent company under the Prevention of Cruelty to Animals Act, 1960 and the Karnataka Prevention of Cow Slaughter and Cattle Preservation Act, 1964. The respondent challenged the FIR proceedings before the Karnataka High Court, which disposed of the writ petitions with certain observations that the complainant felt were damaging to his underlying complaint. The complainant appealed to the Supreme Court against those observations.

Decision Breakdown

The Supreme Court declined to examine the merits of the underlying criminal allegations since the investigation and the trial before the Magistrate were already ongoing. It disposed of the appeal by directing that the Investigating Officer and the trial Magistrate proceed strictly in accordance with law and the evidence, without being influenced in any manner by the High Court's observations, and directed the Magistrate to finally dispose of the case within six months.

Lesson Learnt

Observations a court makes while disposing of a writ petition challenging an FIR are not findings on guilt or innocence: the investigating officer and the trial court must decide the actual case strictly on the evidence, uninfluenced by remarks made at an earlier, different stage of litigation.
