Background

JSK Industries held a "Marine Cargo-Open Policy" from Oriental Insurance covering goods moving "from anywhere in India to anywhere in India," later modified by endorsements to a sales-turnover basis tied to two specific factory locations in Silvassa. The company purchased aluminium ingots that arrived at Jawaharlal Nehru Port and were being transported by road to its factory when one container was stolen in transit. The insurer repudiated the claim, and both the State and National Consumer Disputes Redressal Commissions rejected JSK Industries' complaint, reasoning that the policy (as modified) covered only supplies from the two Silvassa locations, not the port-to-factory leg.

Decision Breakdown

The Supreme Court relied on its earlier ruling in Saurashtra Chemicals, which holds that an insurer cannot defend a repudiation on a new ground not stated in the original repudiation letter. Here, the claim had been repudiated only for exhaustion of the insured amount, yet the National Commission went further and decided the separate, more fundamental question of whether the policy's coverage even extended to this route/goods. The Court held that once the sole stated ground of repudiation was the financial limit being exhausted, the National Commission should have confined itself to that question (or remanded it), not re-characterised the scope of the policy itself. It set aside both Commissions' orders and remanded the matter to the State Commission to decide afresh, specifically on whether there was sufficient balance insurance cover available at the relevant time.

Lesson Learnt

An insurer must stand by the specific ground it gave for rejecting a claim — it cannot, at a later stage, defend the rejection on an entirely different basis; and consumer/appellate forums should confine themselves to deciding the actual ground of repudiation rather than expanding the dispute to unrelated issues.
