Background

The appellant had been held in contempt by the High Court in connection with non-payment of tax dues to a Commercial Tax Officer, and the High Court had ordered his arrest. On appeal, the appellant's senior counsel sought one more opportunity for the appellant to purge the contempt rather than face arrest.

Decision Breakdown

The Supreme Court granted the appellant one further chance: he was permitted to appear before the High Court with a demand draft for Rs. 42,08,818 in favour of the Commercial Tax Officer, two further demand drafts totalling Rs. 2,00,000 payable to the Telangana and Andhra Pradesh State Legal Services Authorities, and a written apology, and to also tender an oral apology in open court on a specified date. The Court deferred the High Court's arrest order by one month to let this process play out, while making clear it had not expressed any opinion on the merits of the underlying contempt finding, and left it to the High Court to pass appropriate orders depending on whether the appellant complied. The appeal itself was disposed of on these terms.

Lesson Learnt

Courts sometimes resolve a contempt matter not by re-deciding guilt but by offering the contemnor a final structured opportunity, payment, apology, and a deadline, to purge the contempt and avoid arrest, without ruling on whether the original contempt finding was correct.
