Background

A motorcyclist died in a collision with a transport corporation bus, leaving a wife and two children. The Tribunal awarded substantial compensation, but the High Court reduced it to Rs.5,76,000 using a lower net-income figure and reduced amounts for other losses. The family appealed for an adequate award.

Decision Breakdown

The Supreme Court allowed the appeal and increased the award to Rs.14,51,000 with 9% interest. It used the income-tax return as the available income evidence but corrected the High Court's deductions, added the future prospects applied in this case and used the age-appropriate multiplier and personal-expense deduction. It also awarded the stated amounts for consortium, affection, estate, life expectation, motorcycle damage and funeral or litigation expenses. The award was to be divided equally, with half deposited for three years and half paid within six weeks after credit for prior payments; the Tribunal could permit earlier withdrawal on application.

Lesson Learnt

Documents such as income-tax returns can be important evidence for accident compensation, but deductions and other loss heads must also be assessed correctly. The specific 2014 sums and categories should not be treated as a universal current compensation formula.
