Background

Public-interest petitions concerned whether Indian-made foreign liquor shops could open on 1 September 2009 despite the applicable closing-day rule. While addressing that dispute, the Kerala High Court also declared discriminatory a different rule permitting toddy shops to open on the first day of the month. Toddy contractors challenged that part of the judgment.

Decision Breakdown

The Supreme Court allowed the appeals and set aside the ruling against the toddy-shop exemption. The exemption had not been challenged in the petitions, supported by relevant pleadings or made the subject of a requested remedy. A court could not declare that separate rule unconstitutional on its own while interpreting another rule without bringing the affected parties before it. The Court did not decide the substantive justification for different treatment of toddy and foreign liquor, and the foreign-liquor ruling was not challenged in these appeals.

Lesson Learnt

People affected by a rule were entitled to have a constitutional challenge properly pleaded and heard before the rule was struck down. This procedural ruling preserved the toddy exemption against that judgment without deciding that every difference between the two liquor regimes was justified.
