Background

The appellant filed an election petition challenging a panchayat election result. The winning candidate objected that the petition could not even be heard because the required Rs. 500 "security deposit" under the relevant Rules had been paid into the government treasury by challan rather than handed over in cash to the designated officer. Both the single judge and the Division Bench of the High Court agreed and threw out the election petition on that technical ground.

Decision Breakdown

The Supreme Court held that the rule requires "deposit" of security, not "cash payment" to the officer personally, even cash handed to the officer would itself ultimately be deposited in the treasury, so a treasury challan deposited in the officer's name, with the receipt produced along with the petition, fully satisfies the rule. The High Court's narrower reading was incorrect. The Court allowed the appeal, set aside the High Court's judgment, and restored the original order that had allowed the election petition to proceed, directing it be decided quickly given how much time had already passed.

Lesson Learnt

Courts should look at the substance of a procedural requirement, here, that the right amount genuinely reached the right authority, rather than rejecting a case on a technicality about exactly how a payment was routed.
