Background

The respondent worked as a casual helper at Hindustan Machine Tools Ltd. (a government company, now declared "sick") for about one year (10.06.1976 to 30.07.1977) before his services were orally terminated. The State referred the resulting industrial dispute to the Labour Court, which in 1988 held the termination illegal and ordered reinstatement with continuity of service. The employer's writ petition succeeded before a Single Judge, but a Division Bench of the Rajasthan High Court reversed that and restored the Labour Court's reinstatement award, prompting the employer's appeal to the Supreme Court.

Decision Breakdown

The Supreme Court held that, given the respondent was only a casual worker for a very short period (240 days) decades earlier, with no evidence on whether he was gainfully employed afterward, the Labour Court should have awarded lump-sum monetary compensation under Section 11-A of the Industrial Disputes Act instead of ordering reinstatement with full back wages and continuity of service. It partly allowed the appeal, modifying the award to direct a lump-sum payment of Rs. 50,000 to the respondent in lieu of reinstatement, to be paid within three months.

Lesson Learnt

Even where a termination is found illegal, courts have discretion under labour law (Section 11-A of the Industrial Disputes Act) to substitute monetary compensation for reinstatement where the employment was brief, casual, and many years have passed: reinstatement is not an automatic remedy in every case.
