Background

This was a writ petition (involving the Municipal Corporation of Delhi as a party) challenging a stay order that had been granted in underlying proceedings before the Central Administrative Tribunal. Before the writ petition could be argued on merits, the same stay order under challenge was itself vacated by the Tribunal on 17 September 2026.

Senior Counsel for the petitioners informed the Court that since the Tribunal had already vacated the stay order that was the subject of this writ petition, the petitioners' grievance no longer survived. The two-judge bench accordingly disposed of the writ petition as infructuous, without going into the merits of the original dispute.

Lesson Learnt

Courts will not decide a case on its merits once the specific order under challenge has already been undone by the lower forum: litigants should track parallel proceedings closely, since a tribunal's own subsequent action can make a High Court petition unnecessary.
